("PaintCam", "we", "us", or "our"), a company registered in Singapore, with its registered office at 16 Raffles Quay, #16-02 Hong Leong Building, Singapore 048581, operates the website paintcam.net and the online store hosted by Shopify, including all related information, content, features, tools, products and services (the "Services").

This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit our website, use our products (PaintCam Eve, Eve+, Eve Pro, Eve Simba), mobile applications (PTC App, PTC Monitoring Centre), make a purchase, or interact with us in any way. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

We comply with the Singapore Personal Data Protection Act 2012 ("PDPA"), the European Union General Data Protection Regulation ("GDPR"), the California Consumer Privacy Act ("CCPA"), and other applicable data protection laws.

2.1 Information You Provide Directly

When you fill out forms on our website (newsletter signup, distributor application, contact form, waitlist registration), create an account, place an order, or communicate with us, you may provide: your name and surname; email address; phone number; country, city, postal code, and shipping address; company name, website, VAT number, and industry (for distributor applications); payment card information and billing address; account credentials (username and password); any message, inquiry, or review you submit; your consent preferences and marketing opt-in choices.

2.2 Information Collected Automatically

When you visit our website, we may automatically collect: IP address and approximate geolocation; browser type and version, operating system, and device type; unique device identifiers; pages visited, time spent, and navigation paths; referring URL and search terms; transaction information including items you view, add to cart, or purchase; cookies and similar tracking technologies (see Section 8).

2.3 Information from Third Parties

We may receive personal information from: Shopify (our e-commerce platform) when you interact with our store; payment processors when you complete a transaction; social media platforms if you engage with our content; trade show and event organizers when you visit our booth (e.g., ISC West, CES, Security Essen); our marketing and business partners.

To provide, tailor, and improve the Services — to process your payments, fulfill your orders, arrange shipping, facilitate returns and exchanges, maintain your account, remember your preferences, create a customized shopping experience, and improve the Services. To respond to inquiries and provide support — when you submit a contact form, distributor application, or other request. Legal basis: legitimate interest (GDPR Art. 6(1)(f)); consent (PDPA).

To send marketing communications — product updates, promotions, partnership news, and newsletters, only if you have explicitly opted in. Legal basis: consent (GDPR Art. 6(1)(a)); consent (PDPA). You may withdraw consent at any time.

To manage distributor partnerships — evaluating applications, onboarding, and maintaining business relationships. Legal basis: legitimate interest and pre-contractual measures (GDPR Art. 6(1)(b), (f)).

4. How We Share Your Personal Information

We do not sell your personal information. We may share your information with the following categories of recipients:

Shopify — our Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services. To help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data from your interactions with our store. Service providers — companies that perform services on our behalf, including: payment processors; email service providers; cloud hosting and IT infrastructure providers; analytics providers; shipping and fulfillment providers. These providers process data only on our instructions and are contractually bound to protect your data.

Business and marketing partners — authorized distributors, resellers, and marketing partners, only to the extent necessary for the partnership or marketing relationship and with your knowledge. Our business and marketing partners will use your information in accordance with their own privacy notices.

Legal and regulatory authorities — when required by law, regulation, legal process, or governmental request, and to enforce our terms or protect our rights.

6. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law. How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, provide Services, comply with legal obligations, resolve disputes, or enforce our contracts and policies. Specifically:

Customer and order data is retained for the duration of the business relationship plus 7 years for tax and accounting purposes. Newsletter subscriber data is retained until you unsubscribe or withdraw consent. Distributor application data is retained for the duration of the partnership evaluation and any subsequent business relationship. Contact form inquiries are retained for up to 2 years. Website analytics data is retained for up to 26 months in aggregated form. Marketing consent records are retained for the duration of the consent plus 3 years as proof of compliance.

When data is no longer needed, it is securely deleted or anonymized.

7. Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below. These rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

7.1 General Rights

Right to Access / Know — you may have a right to request access to personal information that we hold about you and receive a copy. Right to Delete — you may have a right to request that we delete personal information we maintain about you. Right to Correct — you may have a right to request that we correct inaccurate personal information. Right of Portability — you may have a right to receive a copy of your personal information in a structured, commonly used format and request transfer to a third party. Managing Communication Preferences — you may opt out of promotional emails at any time using the unsubscribe link. We may still send non-promotional emails such as order confirmations.

7.2 Additional Rights for EEA and UK Residents (GDPR)

If you reside in the UK or European Economic Area, you additionally have the right to: restrict processing in certain circumstances; object to processing based on legitimate interests, including direct marketing; withdraw consent at any time, without affecting the lawfulness of prior processing; lodge a complaint with a supervisory authority (for Slovenia: the Information Commissioner / Informacijski pooblaščenec). If you are a California resident, you have the right to: know what personal information we collect, use, and disclose; request deletion of your personal information; opt out of the sale of personal information (we do not sell personal information); non-discrimination for exercising your privacy rights. As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

13. PaintCam Products and Applications

PaintCam security products (Eve, Eve+, Eve Pro, Eve Simba) and the PTC App may collect and process data necessary for their operation, including: video and image data captured by the device (stored locally on microSD or in the cloud, depending on your settings); device status, firmware version, and diagnostic data; user settings and preferences; Wi-Fi network information required for device setup.

Video and image data captured by PaintCam devices is controlled by the device owner. We do not access this data unless explicitly requested by the owner for support purposes. Device owners are responsible for complying with applicable surveillance and recording laws in their jurisdiction.

The PTC Monitoring Centre (enterprise web-based application) may process additional data related to multi-device management, response controls, and activity logs, subject to the enterprise customer's own data processing agreements.

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision or lodge your complaint with your local data protection authority.
